Terms of use for MyCampView

1. Scope

These terms of use apply to the use of the MyCampView platform.

MyCampView enables users to share information, experiences and photos relating to destinations, areas and individual pitches or accommodation and to view content provided by other users.

2. Registration and user account

A user account must be created to use certain MyCampView features.

Users must provide accurate information when registering and protect their login details against access by third parties.

Each user is responsible for activities carried out through their user account to the extent that they are responsible for those activities.

A user account must not be used for unlawful purposes or to misuse MyCampView.

3. Use of MyCampView

MyCampView facilitates the exchange of information and experiences relating to destinations, areas and individual pitches or accommodation.

In particular, users can suggest destinations and pitches, add information and features, share experiences and upload photos.

The information provided should be accurate to the best of the user’s knowledge and belief.

4. Content provided by users

Users are responsible for the content they submit.

In particular, users must not publish content that

• violates applicable law,
• infringes third-party rights,
• is insulting, discriminatory, threatening or defamatory,
• contains information known to be false or misleading,
• constitutes unauthorised advertising or spam, or
• contains malware or comparable harmful content.

MyCampView is entitled to review content and, where it violates these terms of use or applicable law, not approve it, restrict it or remove it.

5. Photos and other uploads

Users may upload only photos and other content that they are entitled to publish.

In particular, no photos may be uploaded where publication would infringe copyright, personality rights or other third-party rights.

If people are recognisable in a photo, the user must ensure that its publication is permitted.

6. Rights of use

The user remains the owner of the rights to the content they submit.

By uploading or publishing content, the user grants the operator of MyCampView a non-exclusive, royalty-free, worldwide right to use that content to the extent necessary to operate, present and promote MyCampView.

This right of use includes, in particular, the right to

• display the content on MyCampView websites,
• display it within MyCampView apps,
• technically store and reproduce it and prepare it for different screen sizes or file formats, and
• use it to present and promote MyCampView on its own presences and communication channels.

These terms of use alone do not permit the content to be transferred or licensed to third parties for independent commercial purposes.

As a rule, the right of use ends when the user deletes the content concerned or deletes the user account including its content. Backups created for technical reasons may continue to exist for a limited period.

Statutory retention obligations and other statutory powers remain unaffected.

7. Moderation and reporting content

MyCampView may review content submitted by users before or after publication. There is no entitlement to publication of submitted content.

Moderation is generally performed by human review. If automated processes are used in future to support moderation, appropriate information will be provided.

Users and third parties can report content using the reporting feature provided by MyCampView if they believe that it violates applicable law or these terms of use.

Reports are reviewed promptly, carefully, objectively and without arbitrariness.

In particular, MyCampView may decline to approve content, restrict its visibility or remove it if it violates applicable law or these terms of use.

Where necessary, the reporting party and the affected user will be informed about the decision and the reasons for it.

8. Accuracy and currency of information

A substantial proportion of the information displayed on MyCampView originates from users or publicly available sources.

Despite careful processing, it cannot be guaranteed that all information is accurate, complete and up to date at all times.

In particular, conditions at a destination or pitch may have changed since a contribution was created.

Where appropriate, users should also verify important information, particularly information material to a booking or travel decision, with the respective provider.

9. Availability

There is no entitlement to uninterrupted availability of MyCampView or individual features at all times.

Features may be temporarily restricted or unavailable, in particular due to maintenance, technical faults, security measures or further development.

10. Suspension of user accounts

If these terms of use or applicable law are violated, or MyCampView is misused, the operator may take appropriate measures.

These measures may include removing individual items of content, temporarily restricting the user account or – particularly in the event of serious or repeated violations – suspending the user account.

Affected users should be informed about a suspension and the principal reason for it unless prevented by legal grounds.

11. Deleting a user account

Users may request deletion of their user account or use the feature provided for this purpose.

Upon deletion, the user’s personal data and content will be handled in accordance with statutory requirements and the privacy policy.

If contributions are exceptionally to be retained after an account is deleted, they must not continue to be associated personally with the deleted user account without a corresponding legal basis.

12. Liability

The operator’s liability is governed by statutory provisions.

The operator gives no warranty that information provided by users is accurate, complete or up to date.

Statutory provisions governing responsibility for content provided by users remain unaffected.

13. Changes to the platform

MyCampView is continuously developed. Features may be added, changed or discontinued to the extent that this is reasonable for users, taking their interests into account.

14. Changes to these terms of use

These terms of use may be amended where there is an objective reason to do so, in particular due to changes in the law, new features or changes to the platform.

Registered users will be appropriately informed about material changes.

15. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory statutory provisions provide otherwise.

For consumers, mandatory consumer protection provisions of the country of their habitual residence remain unaffected.
